1. Agreement to Terms

This website is owned and operated by Cynoptec Pty Ltd (ABN 36 654 367 807). These Terms & Conditions set forth the terms under which you may use our website and services. By accessing or using our website, you confirm that you have read, understood, and agree to be bound by these Terms.

2. Membership & Purchases

When purchasing a membership, you agree that: (i) you are responsible for reading the full membership description before committing to purchase; (ii) you enter into a legally binding contract when you complete the checkout and payment process.

Membership pricing is listed on the website. Cynoptec reserves the right to change pricing at any time. Additional taxes or transaction fees may apply depending on your location and payment method.

Membership fees are charged at the frequency selected at the time of purchase (monthly or annually) and will automatically renew unless cancelled prior to the renewal date. It is your responsibility to manage your membership through your member portal.

3. Refund Policy

Cynoptec memberships provide immediate access to forecast content, market intelligence, and member resources as soon as your membership is active. Because the content you have paid for is delivered to you straight away, all membership purchases are final and we do not offer refunds. This includes situations where you change your mind after purchasing, where you purchase an additional membership without cancelling an existing one, or where an automatic renewal occurs. Nothing in this policy excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law that cannot lawfully be excluded. Where a consumer guarantee applies and cannot be excluded, and to the extent permitted by law, our liability for failing to meet that guarantee is limited to resupplying the relevant service or paying the cost of having it resupplied.

4. Intellectual Property & Content Restrictions

All content on this platform (including forecasts, maps, graphics, written analysis, recorded briefings, course materials, website design, layouts, and all related intellectual property) is the exclusive property of Cynoptec. All rights reserved.

Our content is provided exclusively for the personal use of subscribed members. You must not copy, transmit, reproduce, plagiarise, share, or distribute any content in any form, whether electronic, verbal, or printed, without the express written consent of Cynoptec.

In particular, redistribution of our forecasts, insights, or materials to third parties (including but not limited to clients, colleagues, agronomists, consultants, or advisory services) is strictly prohibited. Our intellectual property may not be repackaged, resold, or presented as part of any other service offering.

You may not alter, adapt, or modify any of our content in any manner. Any unauthorised use, sharing, or commercial exploitation of Cynoptec materials will be treated as a breach of copyright and may result in immediate suspension of membership and/or legal action.

5. Forecast Disclaimer

All forecasts, outlooks, and weather-related content provided by Cynoptec are for general informational purposes only. They represent the professional opinion and analysis of Cynoptec at the time of publication and are subject to change without notice.

Forecasts are inherently uncertain. Cynoptec makes no warranty, express or implied, regarding the accuracy, completeness, or fitness for purpose of any forecast. No forecast should be relied upon as the sole basis for any agricultural, commercial, financial, or personal decision.

Cynoptec accepts no liability for any loss, damage, injury, or cost arising from decisions made based on forecast content.

You may cancel your membership at any time through your member portal. Cancellation will take effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period.

You agree to indemnify and hold Cynoptec, its directors, officers, employees, and agents harmless from any demands, losses, liabilities, claims, or expenses (including legal fees) made against them by any third party arising out of or in connection with your use of the website or any services offered on the website, or your breach of these Terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Cynoptec shall not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or relating to the use of, or inability to use, the service.

Cynoptec assumes no liability for: (i) errors, mistakes, or inaccuracies in content; (ii) personal injury or property damage resulting from your access to or use of our service; (iii) any unauthorised access to or use of our secure servers and/or any personal information stored therein.

10. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. Changes will be posted on this page with an updated date. Your continued use of the website or service after any change constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the service.

11. Governing Law

These Terms and any disputes arising in connection with them shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in a court of competent jurisdiction located in Queensland, Australia.
